Ordinance #281 - Noise and Braking Devices

An Ordinance amending Title 9 to add a Section 9.05 concerning noise and braking devices.

BE IT ORDAINED by the governing body of the City of Marion, South Dakota:

That Title 9 of the City of Marion Ordinances is hereby amended to add Section 9.05, which shall read as follows:

    9.05.  Noise.

            1.  Noise.  No person shall make or cause to be made any loud, boisterous, and unreasonable noise or disturbance to the annoyance of any other persons nearby, or near to any public highway, road or common area.

            2.  Braking Devices.  It shall be unlawful to operate a dynamic braking device (commonly referred to as a Jacobs brake) on any motor vehicle, except to avert imminent danger.  A Jacobs brake device is any device that converts the internal combustion engine to an air compressor for the purpose of braking without the use of wheel brakes.

            3.  Violation.  Any violation of this section shall be a Class 2 misdemeanor.
