ORDINANCE AMENDING SECTION 4.04.02 (A) OF THE
MARION
CITY
ZONING ORDINANCES REGARDING REVIEW OF
APPLICATIONS FOR CONDITIONAL USE PERMITS BY THE PLANNING COMMISSION.
BE
IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF
MARION
,
SOUTH DAKOTA
:
That
Section 4.04.02(A), Conditional Uses (A) is hereby amended to read as follows:
An
application for Conditional Use Permit, which is available from the Zoning
Administrator or the City Finance Officer, shall be completed by the landowner
requesting the Conditional Use Permit. The
completed application shall be returned to the Zoning Administrator for review.
The Zoning Administrator shall review the application and shall make a
recommendation to the Board of Adjustment (City Council) to either approve or
not approve the application. The
Zoning Administrator’s recommendation shall include a summary of the
application and the reasons and justification for either its approval or
disapproval.
This
amendment shall not effect any other provision in Section 4.04.02 (A) and those
provisions shall remain in effect.
