Ordinance #269 - Placement of Manufactured Home

AN ORDINANCE AMENDING THE MARION CITY ZONING ORDINANCES CONCERNING THE PERCENTAGE OF NEIGHBORS REQUIRED TO CONSENT TO THE PLACEMENT OF A MANUFACTURED HOME OUTSIDE A MANUFACTURED HOME PARK.  

            BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF MARION , SOUTH DAKOTA :

            That Marion City Zoning Ordinance 3.01.04(6) is hereby amended to read as follows:

            3.01.04 Manufactured Homes (outside of an approved manufactured home park)

             (6)       The applicant shall secure written consent of no less than 75% of the owners of real property within 150 feet of the parcel upon which the manufactured home is to be located.  Street, alleys and other public rights of way shall not be included when calculating the 150 foot distance.  For the purposes of this section, owners of real property shall be considered to be one owner even if the property owner actually owns two or more parcels of real property within the 150 foot distance.
