The City Council of the City of Marion, South Dakota met in regular session on Monday, December 7, 2009, at 8:15 p.m. in the meeting room of the City Building with the following council members present: Mike Ellefson, Jeff Jeno, Bill Konda and Keith Weber, together with the Mayor Ron Globke and Finance Officer Kari Muller. Also attending the meeting was City Superintendent Larry Hopf and City Maintenance Dustin Sulzle. City Engineer Jon Fischer was present from 8:19 p.m. – 9:37 p.m. Turner County Sheriff Byron Nogelmeier was present from 8:15 p.m. – 9:09 p.m. Absent: Dee Herlyn, Dave Viet. The meeting was called to order by Mayor Globke at 8:19 p.m.
Numerous citizens were present and addressed the Council regarding a noise issue. Concerns were expressed regarding loud music from car stereos, most notably in the later evening hours. The City of Marion ordinances were reviewed, with it being determined that the matter could be addressed under the chapter covering Offenses Against Public Welfare – Disorderly Conduct. It was advised the ordinance addresses ‘loud, unreasonable noise’. TC Sheriff Byron Nogelmeier advised the ordinance will be strictly enforced.
Follow-up discussion was held on a property upkeep matter, with it advised that progress has not happened as previously addressed. Council decision was made to direct a letter to the property owner detailing the action needed.
A monthly law enforcement report for the month of November was distributed and reviewed. Nogelmeier provided an update on a dog issue, with discussion held on the city’s ordinance regarding vicious animals. Discussion was held on skunk concerns and related problems with the feeding of stray cats. A revised Turner County Law Enforcement Services agreement was presented and reviewed. Motion was made by Ellefson, seconded by Weber to authorize the Mayor and Finance Officer to sign the Law Enforcement Services Agreement between the City and Turner County. Motion carried.
An update was provided on the sanitary sewer improvements project. Discussion was held on various, related matters, including speed limit signs, black dirt and work to be finished in June 2010. City Engineer Jon Fischer presented the fourth application and recommendation for payment to the contractor in the amount of $655,891.16 for work completed through December 1, 2009. The itemized application was reviewed, with discussion held on various aspects. Motion was made by Konda, seconded by Weber to authorize payment in the amount of $655,891.16 to H & W Contracting. Motion unanimously carried upon roll call vote.
Discussion was held on the ordering of materials for the 5th Street drainage project planned for 2010, with Hopf directed to pursue the matter.
It was advised that the planned spillway repair was unable to be completed this year, as water was still going over the spillway when the work was to be done. The repair will be completed in Spring 2010.
Mayor Globke advised interest has been expressed by Central Farmers Cooperative in leasing a strip of land from the City at the rubble site. The land use would be for additional road access for trucks. Discussion was held on the matter, with various aspects addressed including public safety, gating/access and lease provisions. The decision was made to have the mayor follow up with Central Farmers on the matter.
Discussion was held on the city sirens going off sporadically for unknown reasons. It was advised the matter is being addressed, with Hopf and Sulzle working with dispatch and Vantek Communications on the issue.
Discussion was held on partnering with the Marion B & P Organization on a Hwy 44 sign improvement project, with the decision made to pursue the matter. It was advised the project will also be put before the Marion Development Foundation.
Motion was made by Jeno, seconded by Konda to designate Farmers State Bank as the official depository for the City funds for 2010. Motion carried.
Motion was made by Ellefson, seconded by Jeno to designate the Marion Record as the official newspaper for the City of Marion for 2010. Motion carried.
Muller reminded all of the Community Christmas Celebration to be held on December 12th.
Motion was made by Weber, seconded by Konda to adjourn at 10:15 p.m. Motion carried.

The Marion Business & Professional Organization met on Thursday, December 10, 2009 at 12:00 p.m. at the Tieszen Memorial Home with 15 members in attendance. Businesses present were: Al’s Studio, Central Farmer’s Coop, City Economic Development Coordinator, CPA Heather Hofer, Donlan’s Foodland, Farmers State Bank, Getskow Pharmacy, Hofmeister-Jones Funeral Home, Luke H/C/P, Post Office, Rex’s Plumbing, Schmidt Country, Tieszen Chiropractic Clinic and Tieszen Memorial Home.
Kari Muller, Secretary/Treasurer, distributed the November 18th meeting minutes and a financial report, with both approved as presented.
Final details for the 2009 Community Christmas Celebration were discussed. Information was provided on vendors, inflatables, door prizes and the youth drawings. Discussion was held on the use of the Marion Fire Department’s roasters each year for the celebration, with a suggestion made to consider purchasing our own roasters or making an annual donation to the MFD. Motion was made by Dick Donlan, seconded by Dr. Dean Tieszen to make an annual donation to the MFD in the amount of $50.00. Motion carried.
Discussion was held on the promotional drawing for the month of January. The decision was made to hold a drawing for a Superbowl Party Pack, as donated by Donlan’s Foodland.
Dues for 2010 were discussed. A reminder was given for the one-time $25.00 sign improvement fee to be included with the 2010 dues. It was advised that the sign improvement fee is for Business members. Individual members are not obligated to pay the fee but may do so if they wish. Motion was made by Rex VanHove, seconded by Queena Getskow to set the 2010 annual dues at $105.00 per business member and $55.00 per individual member. Motion carried.
SEFP facilitator stats for 2009 were presented. Information was distributed on the 2010 Regional Career Fair to be held at the Centerville High School on February 17th. All businesses are encouraged to register for a booth at the Career Fair. It was advised that SEFP is expanding into McCook County in 2010.
It was advised an individual has expressed interest in putting an air strip in the area.
The next meeting will be at 12:00 p.m. on January 14, 2010 at the Tieszen Memorial Home.
Pursuant to the call and the notice thereof, the School Board of the Marion School District 60-3, Marion, Turner County, SD met in regular session on the fourteenth day of December, 2009 at 7:00 pm.
Members Present: Bartscher, Koehn, Langerock, Nelson, and Preheim. Absent: None.
Officers Present: Denise Fox, Superintendent; Adam Shaw, Secondary Principal; and Aaron Thompson, Business Manager. Absent: None.
Guests Present: None.
Call to order was made by President of the School Board, Peter Preheim, at 7:03 pm.
Action 09/10-54: Agenda – On motion by Bartscher, second by Nelson to approve the agenda. Motion carried.
Action 09/10-55: Minutes – On motion by Koehn, second by Langerock to approve the previous month’s minutes, and to acknowledge receipt of the Cornbelt Educational Cooperative minutes. Motion carried.
Action 09/10-56: Financial Reports – On motion by Langerock, second by Koehn to approve the financial reports of the District as shown in Table 1 (to be published in paper). Motion carried.
Action 09/10-57: Bills for Consideration – On motion by Bartscher, second by Nelson to approve the following claims against the District for the month of December, and then to approve checks to be issued in their payment. Motion carried. (Bills to be published in paper)
There were no delegations. There were no Teacher Reports.
School Board President Peter Preheim gave the Board information on ASBSD meetings, legislative sessions, and candidates for South Dakota Governor. Preheim also informed the Board that the Marketing Committee had previously met and discussed ideas such as a publishing a column in the weekly newspaper titled “Did You Know?”, which would cover different school, State, and community facts.
Aaron Thompson gave the Business Manager report. He informed the Board on a recent audit on the 2008/2009 financial records, quarterly ARRA reports to be sent to the State of SD, and that the opt-out will be reviewed at next month’s regular meeting.
Adam Shaw gave the Secondary Principal report. He wanted to congratulate the Students of the Month, the Oral Interp team placing in several categories at their competitions, Cara Schardin for All-State Volleyball, Brad Tunge for All-State Football, JHBBB Freeman/Marion coop placing 1st at the Cornbelt Conference tournament, Jesse Kunkel winning the Larsen award at the We the People competition, and the Marion/Freeman wrestlers placing 2nd at a tournament in Lake Andes. Mr. Shaw also informed the Board that the SRP format will be changing after the break.
Denise Fox gave the Superintendent report. She gave the Board information on a Capital Outlay 5-year plan, a roof analysis from Tremco, new gym air conditioning project to begin during the break, Board of Regents college transitions, area Superintendent meetings, the State budget proposal, webpage updates, football uniforms & equipment, the Elementary Christmas concert, a Safe Routes to School grant, and NASA artifacts to schools.
Mrs. Fox and Mr. Shaw gave the Board information on alternative ways for high school students to make up credits for failed classes by using an online course.
Board President Peter Preheim suggested that the Board get together for a special meeting or retreat. The purpose of the meeting would be for the Board to share their thoughts/visions for the Marion School.
Action 09/10-58: Lawsuit Funding – On motion by Nelson, second by Bartscher to contribute $1,000.00 to the SD Coalition of Schools for the South Dakota School Funding lawsuit. Motion carried.
Action 09/10-59: Approve Contract – On motion by Koehn, second by Langerock to approve Heath Hoogshagen’s contract as Asst. Boys Basketball Coach in the amount of $1,800.50 for the 2009/2010 fiscal school year. Motion carried.
Action 09/10-60: Approve Contract – On motion by Bartscher, second by Langerock to approve Denise Fox’s contract as Boys Basketball Cheerleading Advisor in the amount of $484.75 for the 2009/2010 fiscal school year. Motion carried.
Action 09/10-61: Personnel – On motion by Nelson, second by Langerock to go into executive session for the purpose of Personnel – Business Manager Evaluation at 9:15 pm. Motion carried. President of the School Board, Peter Preheim, declared out of executive session at 10:30 pm.
Action 09/10-62: Adjourn – On motion by Bartscher, second by Langerock to adjourn the school board meeting at 10:31 pm. Motion carried.

2009 COMMUNITY CHRISTMAS CELEBRATION THANK YOU to everyone who helped to make the 2009 Community Christmas Celebration such a success!
